Terms of Service
Last updated: September 17, 2026
These Terms of Service ("Terms") are an agreement between you and Simone Nitzan, a sole proprietor based in Ontario, Canada ("Simone," "we," "us," or "our"). They cover your use of Simone Nitzan Courses at simone.thinkific.com, including our online courses, live classes, replays, course materials, and related emails (together, the "Services").
By creating an account, buying a course, or using the Services, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Services.
1. Health and safety: please read carefully
- Education, not medical care. The Services provide general education about movement, yoga, strength, and mobility. They are not medical advice, diagnosis, or treatment. Even where Simone holds health or movement credentials, using the Services does not create a clinical or practitioner-patient relationship.
- Talk to your healthcare provider first. This is especially important if you have an injury, pain, a medical condition, are pregnant or recently postpartum, or are recovering from surgery.
- Listen to your body. Modify or skip anything that doesn't feel right. Stop right away if you feel pain, dizziness, numbness, or shortness of breath, and seek medical attention if needed.
- Online instruction has limits. In recorded and live online classes, the instructor usually can't see you or correct your form. You are responsible for practising in a safe space, on a suitable surface, with appropriate equipment.
- Assumption of risk. Physical activity carries an inherent risk of injury. By using the Services, you choose to participate voluntarily and accept those risks, to the fullest extent permitted by law.
2. Eligibility and your account
You must be the age of majority where you live to create an account or make a purchase. You agree to give accurate information and keep it up to date.
Your account is for you alone. Keep your login details private, and don't share your account or course access with anyone else. You're responsible for activity under your account.
3. Purchases and payment
Prices are shown in the currency displayed at checkout, plus any applicable taxes. Payments are processed by third-party payment processors through our course platform. We never see or store your full card details.
If we offer a payment plan and you choose it, you authorize us to charge the scheduled payments until the total is paid. If a payment fails, we may pause your access until it's resolved.
We may change prices for future purchases at any time. Price changes don't affect purchases you've already made.
4. Refund policy
You can get a full refund if you request it within 7 days of your purchase. To request a refund, email [email protected] with your name and the course you bought. No reason is required.
- Refunds go back to your original payment method. Timing depends on your bank or card provider.
- Your access to the course ends once the refund is processed.
- For payment plans, the 7 days start from your first payment, and we refund all amounts you've paid.
- If we cancel a course before delivering it, you'll receive a full refund.
After 7 days, purchases are non-refundable, except where the law requires otherwise.
5. Course access
When you buy a course, you get access to its materials and available replays for as long as we offer that course on the site. If we retire a course, we'll give you at least 30 days' notice by email so you can finish it.
Live class dates and times may occasionally change. If we cancel a live session, we'll reschedule it or provide a recording.
6. Live classes and recordings
Live classes may be recorded and shared as replays with students enrolled in that course. Recordings focus on the instructor, but your name, image, voice, or chat messages may occasionally appear.
By joining a live class with your camera or microphone on, or by posting in the chat, you consent to appearing in recordings shared this way. If you prefer not to appear, keep your camera off, stay muted, change your display name, or send questions privately. We won't use recordings that show you in public marketing without your permission.
During live classes, you agree to:
- Treat other students and the instructor with respect.
- Not record, screenshot, or share any part of a live class, or other students' images or personal information.
- Not promote your own products or services without our permission.
7. Our content and your license
All course content, including videos, recordings, handouts, written materials, and images, is owned by Simone or her licensors and protected by copyright and other laws.
When you buy a course, we give you a limited, personal, non-transferable, non-exclusive license to use its content for your own non-commercial use. You're welcome to use what you learn in your own practice. You may not:
- Share, sell, or give away course content or your login.
- Download, record, or copy content, except through download features we provide.
- Post course content online or publish it anywhere else.
- Use course materials to teach classes, train clients, or create a competing course or product.
8. Your content and feedback
If you post comments, questions, or other content in the Services, you keep ownership of it. You give us permission to host and display it within the Services so it can be part of the course experience. We may remove content that is offensive, unlawful, or breaks these Terms.
If you send us feedback or suggestions, we may use them without any obligation to you. We will only publish your testimonial, name, or image in our marketing with your permission.
9. Acceptable use
You agree not to:
- Use the Services for any illegal purpose or in a way that harms others.
- Harass, threaten, or mistreat other students or the instructor.
- Interfere with the security or operation of the Services, or upload viruses or harmful code.
- Use bots, scrapers, or other automated tools to access or copy the Services.
- Pretend to be someone else or give false information.
10. Changes to the Services
We may update, improve, or change course content and features over time. If we discontinue a course you've bought, section 5 applies.
11. Third-party services
The Services rely on third-party platforms such as Thinkific, Zoom, and payment processors, which have their own terms. We aren't responsible for their outages, errors, or practices, although we'll do our best to help if something goes wrong.
12. Disclaimers
We work hard to create valuable courses, but results depend on many individual factors. We don't guarantee any particular outcome, such as reduced pain, increased strength, or improved mobility.
The Services are provided "as is" and "as available." We don't guarantee they will always be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
13. Limitation of liability and release
To the fullest extent permitted by law:
- Release for injury. You release Simone from claims for personal injury or loss arising from your participation in the Services, except where caused by gross negligence or wilful misconduct.
- No indirect damages. We're not liable for indirect, incidental, special, or consequential damages, including lost profits or lost data.
- Liability cap. Our total liability for any claim related to the Services is limited to the amount you paid for the course that gave rise to the claim.
Some jurisdictions don't allow certain limits on liability, so some of these limits may not apply to you.
14. Indemnity
You agree to cover any losses, claims, or costs, including reasonable legal fees, that Simone faces because you broke these Terms, misused the Services, or posted content that violates someone else's rights.
15. Suspension and termination
We may suspend or end your access if you break these Terms, for example by sharing your account or course content. In that case, no refund is owed except where the law requires otherwise.
You can stop using the Services at any time. Sections that by their nature should continue after your access ends, including sections 1, 7, 12, 13, 14, and 16, will continue to apply.
16. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If a dispute comes up, please contact us first so we can try to resolve it informally.
If we can't resolve it, disputes will be handled by the courts of Ontario, except where the consumer protection laws of the place you live give you the right to bring a claim there.
17. Changes to these Terms
We may update these Terms from time to time and will change the "Last updated" date when we do. If we make a material change, we'll notify you by email or with a notice on the site before it takes effect. Changes don't apply to purchases made before the change, unless required by law.
18. General
These Terms and our Privacy Policy are the entire agreement between you and us about the Services. If any part of these Terms is found unenforceable, the rest stays in effect. If we don't enforce a right right away, we haven't given it up. We may transfer our rights and obligations under these Terms if the business is sold or transferred.
